Enforcement Defense
___U.S. EPA, MDEQ and other environmental agencies may initiate enforcement action against a company, municipality or individual with regard to alleged violations of permits or other compliance requirements. Examples of enforcement actions include:
• Alleged excessive air permit emissions from a manufacturing plant; • Alleged violations of particulate emissions based on statute and common law; • Alleged criminal violation due to knowing breach of permit requirements or knowingly inaccurate reporting; • Allegedly unlawful discharge of water in volumes or with constituents above permit limits; • Red-tagging and/or penalty imposition on service station owners for alleged violation of compliance or cleanup obligations; and • Alleged violations of reporting requirements under permits or other regulated operations.
